Patient Rights & Responsibilities

Patient Rights :

  1. The patient has the right to considerate and respectful service that respects the patient’s dignity, property,
    and individuality.
  2. The patient has the right to obtain service without regard to race, creed, national origin, sex, age,
    disability, diagnosis, or religious affiliation.
  3. The patient has the right to be fully informed in advance about the care/service to be provided, including
    the scope of services the organization will provide, any specific limitations on those services, the frequency of
    visits, and any modifications to the plan of care.
  4. The patient has the right to be informed, in advance of care/service being provided, of his/her financial
    responsibility for the equipment and service being provided.
  5. The patient has the right to participate in the development and periodic revision of the plan of care.
  6. The patient has the right to make informed decisions about his/her care.
  7. The patient has the right to refuse care or treatment after the consequences of refusing care or treatment have been fully presented.
  8. The patient has the right to receive appropriate, patient-centered care in accordance with the physician’s orders.
  9. The patient has the right to reasonable continuity of care and service.
  10. The patient has the right to choose a healthcare provider, including an attending physician, if applicable.
  11. The patient has the right to be informed of any financial benefit the organization may receive when the patient is referred to another organization.
  12. The patient has the right to be informed of his/her rights under state law to formulate an Advance Directive, if applicable.
  13. The patient has the right to be able to identify visiting personnel members through proper identification.
  14. The patient has the right to be free from mistreatment, neglect, or verbal, mental, sexual, and physical abuse, including injuries of unknown source, and the misappropriation of patient property.
  15. Subject to applicable law, the patient has the right to confidentiality and privacy of all information contained in the patient record and of protected health information (PHI), and to be advised of the organization’s policies and procedures regarding the disclosure of clinical records. Individuals or organizations not involved in the patient’s care may not have access to this information without the patient’s written consent.
  16. The patient has the right to voice grievances or complaints regarding treatment or care, or lack of respect of property, or to recommend changes in policy, personnel, or care/service, without restraint, interference, coercion, discrimination, or reprisal, and to have such grievances or complaints investigated.
  17. The patient has the right to be fully informed of his/her responsibilities as a patient.

Patient Responsibilities:

  1. The patient should promptly notify the Home Medical Equipment Company of any equipment failure or damage.
  2. The patient is responsible for any equipment that is lost or stolen while in their possession and should promptly notify Home Medical Equipment Company in such instances.
  3. The patient should promptly notify the Home Medical Equipment Company of any changes to their address or telephone.
  4. The patient should promptly notify the Home Medical Equipment Company of any changes concerning their physician.
  5. The patient should notify the Home Medical Equipment Company of discontinuance of use.
  6. Except where contrary to federal or state law, the patient is responsible for any equipment rental and sale charges which the patient’s insurance company/companies does not pay.
